Canon City Daily Record, A BILL FOR ORDINANCE NO. 3, SERIES OF 2015 AN ORDINANCE AMENDING SECTION 17.24.050 OF THE MUNICIPAL CODE, TO ADD THERETO A NEW SUBSECTION IDENTIFYING A CERTAIN LAND USE PERMITTED ONLY BY SPECIAL REVIEW [Child Care Center located at 505 Del Rey Ave.] WHEREAS, on or about April 20, 2015 the applicant, Denise Santilli, filed an application for a Special Review use of certain land located within the R-2, Medium Density Residential zone district, pursuant to the requirements of the Canon City Municipal Code; and WHEREAS, said application requested that the said property be approved for use as a "Child Care Center"; and WHEREAS, "Child Care Center" is a use permitted only through special review in the R-2, Medium Density Residential zone district, pursuant to Subsection 17.12.080 C of the Canon City Municipal Code; and WHEREAS, pursuant to adequate notice, a public hearing was conducted before the Planning Commission of the City of Canon City at its regular meeting on May 19, 2015, following which, according to the minutes of said meeting, the Planning Commission, by a vote of 6 in favor, 0 opposed, recommended to the Council of Canon City that the request for Special Review be approved with conditions; and WHEREAS, public notice of the request was mailed to all property owners within 300 feet of the subject property, as required under Subsection 17.24.020 B of the Canon City Municipal Code, and also was published and posted in accordance with applicable law; and WHEREAS, pursuant to adequate notice, a public hearing on the request for Special Review was conducted before the Council of Canon City at its regular meeting on June 1, 2015, during which testimony was heard and evidence was received, including, but not limited to the aforementioned minutes and recommendation of the Planning Commission, reports from the applicant, City staff and other interested parties; and WHEREAS, the Council of Canon City, in accordance with the requirements of subsection 17.24.030 A of the Cañon City Municipal Code, hereby finds and determines: (1) that the special review use application complies with all requirements imposed by Chapter 17.24 of the Canon City Municipal Code and that there are no written rules adopted by the Planning Commission which impose additional requirements other than the recommended conditions; (2) that the special review use requested in the application is consistent with the purposes of Title 17, as declared in Section 17.04.020 of the Canon City Municipal Code; and (3) that the special review use applied for is designed to be compatible with surrounding land uses and the area in which it will be located; and WHEREAS, the Council of Canon City further represents and acknowledges, in accordance with the requirements of subsection 17.24.030B of the Canon City Municipal Code, that it has considered all criteria enumerated in paragraphs 1 through 6 of such subsection and, in light of such considerations, hereby finds that certain limitations, restrictions, requirements or conditions are necessary to reasonably preserve and promote public peace, health, safety and general welfare in the neighborhood in which the requested recreational facility use will be permitted pursuant to this ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF CANON CITY that Section 17.24.050 of the Canon City Municipal Code is hereby amended by the addition thereto of a new Subsection 91 to read as follows: 91. A. Legal Description of Property A portion of Lot 1, Block 40, Fruitmere Subdivision B. Zoning District Designation R-2, Medium Density Residential C. Uses Permitted by Special Review Child Care Center D. Conditions The special review use permitted in this subsection is specifically subject to the following limitations, restrictions, requirements and conditions: 1. The applicant must obtain all required building, electrical and plumbing permits for any construction or alterations that may be necessary and obtain a Certificate of Occupancy if required. The applicant shall comply with any requirements of the Fremont Sanitation District and the Canon City Area Fire District. 2. The applicant shall install 6-foot privacy fencing so that the entire north property line is fenced. A license agreement with the City may be required for the replacement of a fence if any fence is outside the property line. 3. Prior to occupancy of the subject building as the Giving Tree Child Care Center, the applicant shall execute a Future Improvements Agreement with the City for the provision of future public improvements and pay a one-time storm water impact fee of $375.00. 4. The applicant must obtain a State license for the operation of a child care facility at the proposed location, a copy of which shall be provided to the City Planning and Zoning office for its records. 5. Unless otherwise modified by this approval or other subsequent decision of the City Council as it may apply to this request, all material representations made by the applicant in its application submittal and/or in any public hearing shall be binding upon the applicant. The applicant's failure to perform in accordance with such material representations could result in the revocation of this approval. 6. The approval herein granted shall extend only to the tenancy of Giving Tree Child Care Center or a similar organization so long as any subsequent owner/tenant operates the facility in general conformance with this approval, and will terminate if the use is abandoned for a period of time in excess of one year. The annual performance report is know as the Consolidated Annual Performance and Evaluation Report (CAPER) for 2014 and reports the use of Community Development Block Grant Funds (CDBG) and HOME Investment Partnership Assistance Funds (HOME) and Emergency Solutions Grant Funds (ESG). These funds benefited the Adams County entitlement area and citizens who are low- to moderate-income. Adams County's CDBG entitlement includes unincorporated Adams County, the Town of Bennett, and the cities of Brighton, Commerce City, Federal Heights, and Northglenn.
