Denver Post, NOTICE TO THE PUBLIC OF INTENT TO REQUEST RELEASE OF FUNDS July 28, 2013 City and County of Denver Office of Economic Development 201 West Colfax Avenue, Dept. 1011 Denver, Colorado 80202 PHONE 720-913-1998 Fax 720-913-5415 TDD 720-913-1568 kristi.miniello@denvergov.org TO ALL INTERESTED AGENCIES, GROUPS, AND PERSONS: On or about August 12, 2013 the City and County of Denver will request the U.S. Department of Housing and Urban Development (HUD) to release Federal funds under the HOME Investment Partnerships Program (HOME). This program may receive ongoing multi-year funding, pending federal appropriation. This notice will therefore cover future projects under this program, as long as the scope of services does not change significantly; there are no new circumstances and/or environmental conditions that may affect the project or have a bearing on its impact, such as concealed or unexpected conditions discovered during the implementation of the program or activity; or the determination that the original environmental findings are no longer valid. GRANTEE FOR THE PROGRAM: The City and County of Denver HOME GRANT NUMBER:M-13-MC-08-0204 HOME GRANT AMOUNT:$1,913,284 ENVIRONMENTAL FINDING An area-wide environmental assessment for this program has been completed by the City and County of Denver and is available for public examination and copying at the office noted above during general business hours or upon request. Based on this environmental review, it has been determined that a request for release of funds will not significantly affect the quality of the human or natural environment, nor will any of the laws and authorities under 24 CFR Part 58.5 be violated. Hence, an environmental impact statement will not be undertaken under the National Environmental Policy Act of 1969 (P.L. 91-910). PUBLIC COMMENTS ON FINDING All interested agencies, groups, or persons disagreeing with these decisions are invited to submit written comments, in accordance with 24 CFR Part 58.76, for consideration by the City and County of Denver on or before August 12, 2013. All such comments will be considered by the City and County of Denver prior to its taking any administrative action or requesting release of funds after the date listed immediately above. RELEASE OF GRANT FUNDS The City and County of Denver will undertake the program activity described above with funds under the HOME Investment Partnerships Program (HOME). The City and County of Denver is certifying to HUD that the City and Michael B. Hancock, in his official capacity as Mayor, consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to the environmental review, decision making, and action, and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, the City and County of Denver may use HOME funds, and HUD will have satisfied its responsibility under the National Environmental Policy Act of 1969 and other environmental responsibilities listed in 24 CFR Part 58. HUD will accept an objection to its approval of the release of funds and acceptance of the certification only if it is on one of the following bases: (a) that the certification was not in fact executed by the Certifying Officer of the City and County of Denver, (b) that the environmental review record for the project omitted a required decision, finding, or step, or (c) that another Federal Agency has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedure at 24 CFR Part 58.76 and may be addressed to HUD at 1670 Broadway, Denver, Colorado 80202-4801.
