Chapter 10, Article IX Date : 5/8/13 The Manager of Community Planning of Development of the City and County of Denver issued a Notice of Violation(s) alleging the above-referenced property, including building(s) located thereon ("Property"), to be in violation of 10-138(c) of the Denver Revised Municipal Code ("D.R.M.C." or "Code") and the owner to have violated 10-138(d). The City further alleges that you either did not submit a remedial plan pursuant to 10-139(c) of the Code or submitted a plan that was found to be unsatisfactory. You are hereby ordered to show cause before the manager (or his designee) why the proposed enforcement action should not be taken. If an appeal of a decision of the manager has been filed, the hearing on appeal and show cause hearing are hereby consolidated. A Show Cause Hearing regarding the above-captioned matter will be held promptly at 9:00 a.m. on August 7, 2014 in conference room 2.D.4 on the 2nd floor of the Wellington Webb Municipal Office Building located at 201 West Colfax Avenue, Denver, Colorado 80202. REASONS ENFORCEMENT ACTION IS TO BE TAKEN: 1. The Property is unsafe as defined in the Denver Building Code. 2. For any three consecutive months, the Property has not been lawfully occupied, has been wholly or partially boarded up, and has not shown evidence of substantial and ongoing construction activity 3. The Property is not lawfully occupied and has been in viola tion of any provision of city or state law on three (3) sepaate occasions within a two-year period. 4. The Property is not lawfully occupied and the tax on the premises has been due and unpaid for a period of at least one year. 5. The Property, is a neighborhood nuisance as that term is defined in 10-138(b)(11) of the Code. 6. The Property is a historic property that is not being pre served in accordance with chapter 30 of the Code. PROPOSED ENFORCEMENT ACTION: 1. Assessment of civil penalties under 139(m) of up to $999.00 per day for each day 10-138(c) and 138(d) are violated and other penalties, fees, and costs as provided in 10-141 and 10-143 of the Code. 2. Judicial enforcement, including petitioning district court for an injunction and recovery of fees and costs under 139(n) of the Code. 3. Court action including appointment of receiver to take possession and control of the property pursuant to 10-140 of the Code. 4. Placement of the property on the Neglected and Derelict property list and assessment of a $1000 yearly non- refundable fee under 10-141. 5. Registration of property owners and agents under 10-143 of the Code. 6. Posting of no trespassing signed and other warnings as set forth in 10-139(o). Pursuant to 12-19 of the Code, individu als may represent themselves or be represented by an attor- ney. As authorized by 10-139(h) of the Code, if you fail to appear, the hearing will be conducted in your absence. All hearings are conducted in English. Any party that would ike the assistance of an interpreter for the hearing is responsi- ble for bringing an interpreter to the hearing. A copy of the file regarding the Property, including exhibits to be submitted at the hearing, will be available at the 2nd floor Records reception desk 30 minutes before the hearing begins or sooner by prior arrangements.
