REQUEST FOR THE RELEASE OF FUNDS On or about June 5, 2015 the City and County of Denver will submit a request to the U.S. Department of Housing and Urban Development (HUD) on behalf of Volunteers of America for the release of HOME funds to undertake construction and permanent financing on an affordable senior rental community. ESTIMATED FUNDING: $860,000 PROJECT LOCATION: 4355 Carson Street, Denver CO NATURE AND SCOPE OF THE PROJECT: The purpose of this project is to construct an 86-unit affordable senior rental community contained in one, four-story building, in Denver's Montbello neighborhood. The project site is currently vacant. The project will include 65 one-bedroom units and 21 two-bedroom units at 30%, 40%, 50%, and 60% AMI. FINDING OF NO SIGNIFICANT IMPACT The City and County of Denver has determined that the project will have no significant impact on the human or natural environment. An Environmental Impact Statement (EIS) under the National Environmental Policy Act of 1969 (NEPA), therefore, is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the office noted above and may be examined or copied weekdays 8:00 a.m. to 5:00 p.m. PUBLIC COMMENTS Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the City and County of Denver at the office noted above. All comments received by June 5, 2015, will be considered by the City and County of Denver prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. RELEASE OF FUNDS The City and County of Denver certifies to HUD that Michael B. Hancock, in his capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City and County of Denver to use Program funds. OBJECTIONS TO THE RELEASE OF FUNDS HUD will accept objections to its release of funds and the City and County of Denver's certification for a period of fifteen (15) days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are made on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City and County of Denver; (b) the City and County of Denver has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before the approval of a release of funds by HUD; or (d) another Federal agency, acting pursuant to 40 CFR Part 1504, has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures of 24 CFR Part 58 and shall be addressed to the HUD Region VIII Office, 8ADE, at 1670 Broadway, Denver, Colorado 80202-4801.
